| 内容記述 | 先住民族と密接につながる土地において，これらの民族の文化・生活に多大 な影響を及ぼす大規模開発事業が世界各地で計画または実施されている。一方 で先住民族は，所有または占有する土地と天然資源に対する権利および自決権 などの権利の承認と保護とを，国家および国際社会全体に対して主張してきて いる。そしてその文化と土地に影響するような大規模な開発行為に際して，関 係民族がその権利の尊重と保障を求め，その実施のために当該開発行為に関す る当該民族による事前の，自由なインフォームド・コンセント（FPIC）原則を 関係当事者が履行するよう主張している。 本稿はこのFPIC 原則の意義および具体的な内容に関して，最近までの国連 その他の国際的フォーラムでの議論と関係法文書の概要ならびに地域的国際人 権保障機構での事例を分析して同原則の法的な展開を追跡することを目的とす る。 |

| 内容記述 | Many large-scale development projects have been planned and carried out in lands which indigenous peoples have traditionally occupied, owned or used. These projects often adversely affect the lives and cultures of the peoples caught up in the process. However, indigenous peoples and their organizations have maintained that their rights to the land and natural resources should be recognized and respected by the State concerned as well as by the international community as a whole. In particular, they demand that their rights should be safeguarded in cases where the negative effect of the development project is so grave that their distinct culture and identity or physical survival is at risk. In such cases, respect for, and realization of, their free, prior and informed consent towards the development is the most fundamental principle. This article aims to highlight the legal development of the principle through a comparative analysis of the relevant cases as well as authoritative texts and documents in international human rights law. |
