| 内容記述 | 日本の非営利組織（NPO）の法制的な整備は1898 年の民法の施行に始まる。 100 年後の1998 年に特定非営利活動促進法が施行された後，「NPO」という用 語が広がったため，日本における非営利組織は比較的新しいものという主張が 広まり，日本の伝統的組織との連続性が必ずしもしっかりと認識されてこな かった。それに対して，今田忠は江戸時代設立した講で現存する講があること から，講は日本のNPO の1 つのルーツであると主張した。 本稿では明治民法成立前の時点での「講」の特性と，現代の非営利組織の特 性とを比較した。感恩講と一新講という明治民法施行前から存在していた2 つ 講を事例に取り上げ，目的，運営，ガバナンスなどを検討した。感恩講は，財 産を維持し，理事会に相当する意思決定機関を有して，現代の財団の特性と共 通する。また，一新講は社員に相当する講員を有し，社員総会による意思決定 を行っていた。両講ともに，明治民法施行前時点ですでに現代的な意味での非 営利組織としての特性を有していたことが明らかになり，今田説を強く支持す ることとなった。 |

| 内容記述 | The law on nonprofit organizations (NPOs) in Japan was put into effect on the enactment of the Civil Code in 1898. The Specified Nonprofit Activities Promotion Act was promulgated in 1998. The Roman letter acronym “NPO” has been in almost exclusive use since the latter act came into force. In consequence, it has been widely supposed that nonprofit organizations in Japan are relatively new and that there is no continuous relation between con- temporary NPOs and traditional organizations. Makoto Imada, on the contrary, has put forward the hypothesis that the traditional Japanese organization, or “Ko”, is one of the roots of today’s NPOs, because a “Ko” established in the Edo period has survived up to the present. This paper takes as case studies two “ Ko” : the “Kan-on-ko” and the “Isshin-ko” of the pre-Civil Code era and examines their missions, purposes and governance. The “Kan-on-ko” had sustained endowment and a board of directors. These can be pointed out as characteristics of a foundation. The “Isshin-ko” had both members and a general meeting of members as a decision- making body. These can be pointed out as characteristics of an association. They are characteristics sufficient for modern nonprofit organizations. It will be found that multiple modern factors exist among the “Ko” of the Pre- Civil Code era. Hence, this paper endorses Imada’s hypothesis. |
